Last Updated: September 7, 2026

NOTICE: These Terms and Conditions govern Your use of the Burns Hauling and Tractor Work website and any online functionality provided through it.

By accessing or using Our website, submitting a service or estimate request, making an online payment, or otherwise using features offered through Our website, You agree to these Terms and Conditions and acknowledge Our Privacy Policy.

If You do not agree, please discontinue use of Our website.

GENERAL PROVISIONS
This website is owned and operated by Burns Hauling and Tractor Work, a business based in Linn County, Oregon.
Use of this website is at Your own risk. We use third-party technology and hosting providers and take reasonable measures to maintain Our website, but We do not guarantee uninterrupted, error-free, or completely secure access.
These Terms may be changed from time to time.

OUR SERVICES
Burns Hauling and Tractor Work provides hauling, tractor work, property and acreage maintenance, cleanup, and other related services as agreed upon with individual customers.

Information provided on Our website is intended to provide general information about Our business and services.
Website descriptions, photographs, examples of prior work, or general pricing information do not constitute a binding quote, guarantee, or promise that a particular service can be performed at a particular property.

The specific scope, price, timing, and conditions applicable to a customer project may be established separately through an estimate, quote, invoice, service agreement, email, text message, or other written communication.
Where a separate written estimate, agreement, invoice, or proposal conflicts with these general website Terms, the terms specific to that customer project will control with respect to that project.

ESTIMATES AND QUOTES
Unless otherwise stated in writing, estimates and quotes are based on the information reasonably available at the time they are prepared.

Pricing may change if actual site conditions, quantities, access requirements, disposal requirements, material needs, equipment needs, labor requirements, or the requested scope of work differ from the information originally provided.
Additional work requested by the customer may result in additional charges.
An estimate is not a guarantee of final cost unless Burns Hauling and Tractor Work expressly identifies it in writing as a fixed-price agreement.

CUSTOMER-PROVIDED INFORMATION
Customers are responsible for providing accurate information regarding:

  • The location where services will be performed

  • The requested scope of work

  • Property ownership or authorization to request the work

  • Property boundaries when relevant

  • Access restrictions

  • Known underground or above-ground utilities

  • Septic systems, irrigation systems, wells, drain fields, underground tanks, wires, pipes, or other concealed improvements

  • Known hazardous conditions

  • Other information reasonably necessary for safe and appropriate performance of the requested work

Burns Hauling and Tractor Work may rely upon information provided by the customer when estimating, scheduling, or performing services.

PROPERTY ACCESS AND AUTHORIZATION
By requesting services, You represent that You own the property where services are to be performed or have sufficient authorization from the property owner to request and approve the work.
You are responsible for ensuring reasonable access to the work area for personnel, trucks, trailers, tractors, machinery, and other necessary equipment.

If access is unsafe, obstructed, materially different from what was represented, or otherwise unsuitable for the requested work, Burns Hauling and Tractor Work may delay, modify, or decline the work.
Additional labor, travel, equipment, or time caused by undisclosed access limitations may result in additional charges where agreed or permitted.

PROPERTY BOUNDARIES AND UTILITIES
The customer is responsible for identifying property boundaries and notifying Burns Hauling and Tractor Work of known utilities, septic systems, irrigation, wells, drain fields, underground structures, private utility lines, or other concealed property features that may affect the work.
Burns Hauling and Tractor Work is not a surveying service, utility-location service, engineering firm, or excavation-design service.

Nothing in these Terms eliminates any responsibility Burns Hauling and Tractor Work may have under applicable law, including legal requirements concerning utility locating or safe excavation practices.

SITE CONDITIONS AND INHERENT RISKS
Hauling, tractor work, grading, cleanup, vegetation removal, material movement, and related services involve heavy vehicles and equipment.

Customers acknowledge that these activities can affect soil, gravel, lawns, landscaping, driveways, access roads, drainage, and surrounding areas.

Soft soil, mud, hidden objects, slopes, weather, vegetation, existing deterioration, underground conditions, and limited access may increase the risk of incidental disturbance.

Burns Hauling and Tractor Work will use reasonable care in performing agreed services but cannot guarantee that heavy-equipment work will leave surrounding surfaces or property entirely undisturbed.

WEATHER, EQUIPMENT, AND SCHEDULING
Service dates and completion estimates may be affected by:

  • Weather

  • Unsafe site conditions

  • Wildfire or other emergency conditions

  • Equipment maintenance or mechanical failure

  • Material availability

  • Disposal-site availability

  • Road or access conditions

  • Illness

  • Events outside Our reasonable control

Burns Hauling and Tractor Work may reschedule work when reasonably necessary for safety, equipment availability, site conditions, or other operational reasons.
Unless specifically guaranteed in writing, estimated service dates and completion dates are not guaranteed.

HAZARDOUS OR PROHIBITED MATERIALS
Customers must disclose if materials to be hauled, moved, disturbed, or removed contain or may contain hazardous, regulated, contaminated, or prohibited substances.
Burns Hauling and Tractor Work reserves the right to decline materials or work that We reasonably believe may be unsafe, unlawful, hazardous, or beyond the agreed scope of service.
Additional requirements or costs associated with previously undisclosed materials may be addressed before work continues.

PAYMENTS
Burns Hauling and Tractor Work may accept payments directly or through online payment functionality provided through Our Wix website.

Online payments may be processed by Stripe and/or another payment service made available through Wix.
By submitting a payment, You authorize the applicable payment processor to charge the payment method You provide for the authorized amount.

Burns Hauling and Tractor Work does not guarantee the availability of any particular payment method.
Any project-specific payment schedule, deposit, balance-due date, or other payment requirement provided on an estimate, invoice, proposal, or separate agreement will apply to that project.

REFUNDS
Due to the nature of services provided, payments for work already performed, labor already provided, materials already purchased, disposal fees already incurred, or other nonrecoverable project expenses may not be refundable.
Any refund, cancellation credit, or adjustment will be determined according to the applicable estimate, invoice, service agreement, or other written agreement and applicable law.

CHARGEBACKS AND PAYMENT DISPUTES
If You believe a payment was processed incorrectly or dispute a charge, please contact Burns Hauling and Tractor Work promptly so We have a reasonable opportunity to investigate and attempt to resolve the issue.
We reserve the right to provide invoices, estimates, communications, proof of authorization, proof of services performed, photographs, transaction records, and other relevant information to a financial institution or payment processor investigating a payment dispute.

CANCELLATIONS AND RESCHEDULING
If You need to cancel or reschedule scheduled work, please contact Us as soon as reasonably possible.
Project-specific cancellation policies, deposits, mobilization charges, material costs, or other terms communicated in writing for a particular job will control.
Burns Hauling and Tractor Work may reschedule or cancel services due to weather, safety concerns, equipment issues, access limitations, nonpayment, undisclosed site conditions, or other circumstances that reasonably prevent performance.

NO GUARANTEE OF RESULTS

We do not guarantee a particular result except where a specific result or standard is expressly included in a written agreement.

Before-and-after photographs or examples of previous projects are illustrative only and do not guarantee identical results on another property.
